Federal and State Laws

The Cultural Resource Department (CRD) of the Squaxin Island Tribe consults with various agencies (federal, state, counties, and cities) on undertakings and projects that have the potential to effect significant cultural resources. The CRD also works with these agencies on non-development cultural resource related projects (reviewing agency historic preservation plans and historic research of places, etc.). The majority of consultations are triggered by one of the environmental laws listed below:

Federal Laws
National Historic Preservation Act (NHPA)
– Section 106 (Implementing Regulation 36 CFR 800)
– Section 304
National Environmental Policy Act
Native American Graves Protection and Repatriation Act (NAGPRA)
Archaeological Resource Protection Act
Indian Scared Sites Act (EO 13007)
Preserve America (EO 13287)

Washington State Laws
Executive Order 21-02 (formerly 05-05)
Archaeological Sites and Resources (RCW 27.53)
State Environmental Policy Ac
Archaeological Excavation and Removal Permit (WAC 25-48)
Archaeological Site Public Disclosure Exemption (RCW 42.56.300)
Indian Graves and Records (RCW 27.44)

The counties and cities that consult with the CRD have their own rules and regulations regarding Reasonable Use Exemptions and Notice of Applications. These are too numerous to list here.

If you are looking to consult with the CRD on an undertaking or a project, please go to the Environmental Project Procedures and Review section.
